Overview

The Firm provides legal representation to clients in arbitration and in the court proceedings that surround it — from securing urgent interim relief and constituting the arbitral tribunal, through the arbitral proceedings themselves, to challenging or defending an award before the courts.

Arbitration is meant to be faster and more commercially efficient than litigation, but that promise depends heavily on protecting a party’s position early — urgent relief under Section 9, or Section 17 before the tribunal itself, is often what makes the eventual award worth having. The Firm places particular emphasis on moving quickly at this interim stage, and on drafting Section 34 challenges with discipline, since courts are confined to a narrow set of statutory grounds and cannot reappraise an award on its merits.

Facets of Arbitration Practice

  • Section 9 — Interim Measures — applications before the court for urgent interim relief, before, during, or after arbitral proceedings, to protect a party’s position or preserve the subject matter of the dispute
  • Section 11 — Appointment of Arbitrator — applications for court-directed appointment of an arbitrator where the parties are unable to agree, or a party fails to act as required under the arbitration agreement
  • Representation in Arbitral Proceedings — representing clients before arbitral tribunals through pleadings, evidence, and final arguments, including applications for interim relief before the tribunal itself under Section 17
  • Section 34 — Setting Aside of Awards — applications challenging an arbitral award on the limited grounds available under the Act
  • Section 37 — Appeals — appeals against orders passed under Section 9, Section 34, and other appealable orders under the Act
  • Enforcement of Awards — proceedings for enforcement of a domestic or foreign arbitral award as a decree of the court

Applications under Section 9, Section 34, and Section 37, and Section 11 applications in domestic arbitration, are made before a High Court. Section 11 applications in international commercial arbitration lie before the Supreme Court. The arbitral proceedings themselves are conducted before the tribunal, wherever the seat of arbitration may be.

The Firm is equally equipped to act before other High Courts across India where the seat of arbitration or a client’s matter requires it.
