Overview

Constitutional law involves matters that test the validity of laws and executive action against the framework of the Constitution, and disputes concerning the rights of citizens and entities vis-à-vis the State. The Firm advises and represents clients on both sides of such disputes: petitioners seeking to enforce their rights, and parties defending State or institutional action.

Constitutional matters are often time-sensitive and intersect closely with administrative and regulatory law, so the Firm places particular emphasis on early strategic assessment — including the correct choice of forum, whether interim relief is available, and how a matter is likely to be viewed by a court weighing individual rights against institutional or policy considerations.

Facets of Constitutional Cases

  • Fundamental Rights & Judicial Review — challenging legislative and executive action that infringes rights guaranteed under Part III of the Constitution
  • Public Interest Litigation — appearing for petitioners and respondents in matters raising issues of public importance
  • Challenges to Statutes & Delegated Legislation — testing the constitutional validity of primary legislation, as well as rules, regulations, and notifications framed under it
  • Government & Regulatory Litigation — challenging executive action, policy decisions, and administrative orders, particularly involving the Union of India, its ministries, and regulators

The Firm’s constitutional law practice is primarily conducted before the Delhi High Court, whose Article 226 writ jurisdiction extends beyond Fundamental Rights to any legal right, and which — given the concentration of Union ministries, departments, and regulators headquartered in Delhi — is the sought after forum for most constitutional challenges to central government action. The Firm also appears before the Supreme Court under Article 32, and in appeal from High Court decisions by way of Special Leave Petition under Article 136.

While the Delhi High Court and the Supreme Court remain the primary forums, the Firm is equally equipped to appear before other High Courts across India, either directly or in coordination with local counsel, where the cause of action or a client’s circumstances call for it.
