Overview

The Firm’s civil law practice covers the everyday backbone of civil litigation — recovering money that is owed, protecting rights and property through injunctions, and enforcing or resisting contractual obligations before the civil courts.

In recovery and injunction matters, timing often matters as much as merit — an asset can be sold, possession can change hands, or a debtor can become harder to trace while a suit is pending. The Firm places particular emphasis on moving early for interim relief, and on using the summary procedure available under Order XXXVII to shorten the timeline for genuine, well-documented money claims rather than defaulting to a lengthy regular trial where it isn’t necessary.

Civil suits are conducted primarily before the District Courts of Delhi, with higher-value suits falling within the Delhi High Court’s original civil jurisdiction. The Firm also handles the resulting appeals, and is equally equipped to act before courts in other jurisdictions across India where a client’s matter requires it.

Areas of Practice

  • Recovery Suits — money recovery suits, including summary suits under Order XXXVII CPC based on negotiable instruments and written contracts, and regular suits for recovery of outstanding dues
  • Injunctions — interim and permanent injunctions to protect possession of property, restrain breach of contract, or prevent interference with business and contractual rights
  • Specific Performance — enforcing contracts for the sale or transfer of property and other agreements where damages alone would not be adequate relief
  • Property & Title Disputes — suits for declaration of title, partition, and recovery of possession
  • Breach of Contract & Damages — civil suits for breach of contract and recovery of damages or compensation
  • Declaratory Suits — suits seeking a formal declaration of legal rights, status, or entitlement
