Overview

The Firm’s intellectual property practice is focused on enforcement and litigation — protecting and defending trademarks, copyrights, patents, and designs before the courts, rather than the prosecution or registration process itself. The Firm is equipped to act for rights holders seeking to protect their IP and for parties defending against infringement claims.

The initial stage of an IP dispute is crucial — an injunction obtained (or resisted) early can determine the outcome of the entire dispute. The Firm places particular emphasis on moving quickly: securing urgent ex-parte relief where warranted, and building the evidentiary record — through Local Commissioner reports, market surveys, and documented instances of infringement — needed to sustain that relief through to trial.

Facets of IP Practice

  • Trademark Infringement & Passing Off — civil suits for infringement of registered trademarks and passing off of unregistered marks, including urgent interim and permanent injunctions
  • Copyright Infringement — enforcement actions covering literary, artistic, musical, and cinematograph works, as well as software and digital content
  • Patent Infringement — infringement suits and defense, including applications for interim relief and revocation counterclaims
  • Design Infringement — protecting and defending registered designs against unauthorized reproduction
  • Anti-Counterfeiting & Enforcement — John Doe (Ashok Kumar) orders against unidentified infringers, and search-and-seizure actions through court-appointed Local Commissioners
  • Rectification & Cancellation Proceedings — challenges to the validity of trademark and patent registrations, now heard directly by the High Courts following the abolition of the Intellectual Property Appellate Board (IPAB) in 2021

The Firm’s is equipped for IP litigation practice conducted before the Delhi High Court, which has a dedicated Intellectual Property Division (IPD), hearing both original infringement suits and the rectification/cancellation jurisdiction previously exercised by IPAB — making it one of the most active and specialized IP forums in the country. The Firm can provide representation before the Supreme Court in appeal, and is equally equipped to act before other High Courts across India, either directly or with local counsel, since counterfeiting and infringement often span multiple jurisdictions.
